Prosecutors sought the records to map out communication data from calls made directly to and from the White House as President Trump and his advisers interacted with GOP lawmakers. Smith defended the move as essential evidence to understand Trump’s mindset, Blackburn argues the gag orders placed on phone carriers violated her constitutional rights under the Speech or Debate Clause. She seeks a symbolic one dollar in damages and an order to completely destroy the records.
